Archbishop Viganò says that humanely nothing can be done, but asks for a humane gesture to the Swiss guards to arrest Bergoglio and Fernández. If he were to seek a solution, then it would be the Code of Canon Law on the ecclesiastical office. The Universi Dominici Gregis says in articles 76 and 77 that if Canon 322.2 is not applied, then the person elected has no right to office and his subsequent acts are not valid. And the facts show that it has not been applied. This means a usurpation of the ecclesiastical office of Roman Pontiff because it is illegitimate. Says 1381: "Whoever usurps an ecclesiastical office, let him be punished with a just penalty." In the second paragraph, he also states: "The illegitimate retention of the office after the deprivation or cessation of the same is equivalent to usurpation." Bergoglio's pontificate is not legitimate, as any action against him must be in accordance with the above Apostolic Constitution.
