Flashback: "Saruman" Taylor Marshall's False Dichotomies on Francis

Dr. Taylor Marshall's podcast from Wednesday discusses Bergoglio and "civil unions"as well as Francis's status as Pope starting right about minute 27.

Unfortunately, Marshall sets up a false dichotomy. He represents our choice of responses as, "Bergoglio is a heretic, let's start a new Church," or "Bergoglio's the Pope and that's just the way it is." Who ever said anything about starting a new Church? There have been a number of anti-popes during the course of history and dealing with them has never meant that.

Then he uses the annulment analogy, and another false dichotomy sets in. Either a couple decides for themselves (which is wrong) or the couple waits passively for the judgment of the Church, declaring themselves incompetent even to form and advance a reasoned opinion.

This is ridiculous.  If people couldn't form their own judgment, they couldn't petition the Tribunal in the first place. How could you wait for and submit to the judgment of the Church if the Church receives no petition to judge?

Like Gandalf talking to Saruman, I reject the options that Taylor has outlined here. I wonder, does he have others to offer?  Because God does, and so does Canon Law.

Make this a practice. By doing this you are doing more good than reading anything here or anywhere else on the Internet.

With regard to this question, each person must follow his or her own conscience. Supposing that both die within the next couple of years. Not an unreasonable assumption given the current “medical” care and advice provided at the Vatican as one religious Latin scholar recently pointed out. Would a council of bishops then have to decide whether the Bergolio papacy was invalid for any of several possible defects? If that were to be the case to come, it would still be the work of the Holy Spirit. At least one saint on record as backing an antipope.

Father Kramer asserts [The Case Against Bergoglio, digital version page 479]:

““The incontestable fact that Pope Benedict XVI has maintained some claim on his papal munus proves absolutely, that he remains in full possession of the primacy as a result of the conditionality of his renunciation of the munus. The reason for this is that the nature of the papacy is such, that the actual holder of the office possesses the primacy in virtue of the Petrine munus which he possesses in its absolute and indivisible fullness, so that a pope who would attempt to renounce the papal office by an act that lacks a total and unconditional renunciation of the munus, by the very act of his stipulating a qualifying condition of the renunciation, whereby the intention is asserted in the act, to retain anything whatsoever of the munus he received from Christ upon his election, albeit only “spiritual” and not jurisdictional, nullifies the act in virtue of the fatal equivocation brought about by the logical opposition of contradictory assertions made in the act.”

What is the ontological nature of Pope Benedict’s act of renunciation? Depending on the answer to this question determines whether Francis is a true or false pope.

In any communication three things are necessary. The speaker, a medium of transmitting, and the recipient of the message. In Benedict’s declaration of February 11, 2013, what was the true significance or import on the hearers of the communication? Obviously the Vatican Secretary of State Cardinal Sodano has advance notice of Benedict’s impromptu delivery. In the same venue after Benedict’s declaratio, the cardinal gave his explanation from prepared text in his hand. Benedict therefore must have discussed the matter with someone beforehand.

In her book on the St. Gallen Mafia, the author Julia Meloni details Benedict’s subjective state of mind leading up to the resignation. Her research points to Benedict’s wanting to give up the responsibilities of the papal office at an opportune time, alluding to his modus operandi by reference to his having previously walked away from military responsibility toward the end of WWII, and his self-comparison to the legendary bear of St. Corbinian who was eventually set free from obligations in Bavaria.

It is important to keep in mind that the answer to the question under consideration does not depend on a strict legalistic interpretation of words or grammar. The subjective intent of the communicator always comes into play. Perhaps this is what Francis had in mind when he instructed the young people of Rome to make a mess. Life itself can be a messy business at times.

I would take issue with the apparent dichotomy between munus and magisterium. Benedict’s resignation was complete if in fact he was using “munus” in an analogous sense when he said that he was keeping the munus with regard to the spiritual dimension only. One could ask whether Pope Celestine IV who resigned in 1241 and at whose grave Benedict mysteriously visited on several occasions before his own resignation, did in fact preserve some element of this munus in an analogous sense, especially while being under “house arrest” (not unlike Benedict) before his death that same year. What Benedict was really getting at was that any pope who voluntarily resigns does not lose a certain spiritual characteristic (munus) which he received as gift from God when he accepted the vocation to become pope. In fact, Benedict implies that it would be impossible for any pope to not have this gift after retirement.

As to Father Gruner, my recollection is that his priestly faculties were suspended for a time, and that he finally reconciled with John Paul II shortly before his death.

Dr Mazza: In a Patrick Coffin Media interview transcribed by The Catholic Monitor, Catholic historian Edmund Mazza explains why Pope Benedict XVI's resignation appears to be in "substantial error" and is therefore not a valid "papal resignation":

But the fact of the matter is he could be in just error. You know just genuine sincere error; if that’s not the way the mechanics of the church, if that’s not a correct ecclesiology...
... That’s the thing. People again look at scholars like myself and say, What do you think your doing? Do you think that Benedict didn’t know how to resign? Do you think that he didn’t know what he was doing? He says it was free. He says just accept him at his word, but that’s the thing Patrick. We are accepting him at his word and his word is that there’s more to go on than meets the eye here. He’s been very open about it, like you say and substantial error means again, your will chose something, when your intellect was operating on error. And that means that your will was not free. So Canon 332.2, star date point 2 says, “In order for a papal resignation to be valid, its got to be free,” but according to the church’s moral theology, if you commit substantial error your will is not free.
