Yes, Biden’s policy was disastrous and Trump is right vigorously to reverse it. But the rule of law and due process are even more fundamental to justice and the common good than immigration policy. To flout them in the name of a good cause will only hurt that cause. And while the

Consider that Joe Biden allowed approximately 20 million illegal aliens into our country. This placed extraordinary burdens on our country--our schools, hospitals, housing, and other essential services were overwhelmed. On top of that, many of these illegal aliens committed
Show moreDr Feser,
I appreciate your defense of due process and natural law as foundational to justice, especially in the context of Abrego Garcia’s deportation to CECOT. You’re right that bypassing due process risks undermining the common good, a principle I share as long as the laws don't contradict eternal and/or natural law. However, his civilly confirmed MS-13 affiliation (and MS-13's pending FTO status) arguably justifies deportation to protect society on natural law grounds. The flaw in his deportation was procedural: the U.S. ignored a judge’s withholding order, prompting the Supreme Court’s return directive.
Yet, as a non-citizen, Abrego Garcia’s case is likely a low priority for the State Department. El Salvador, with greater sovereignty over its own citizen’s treatment, isn’t obligated to return him, and the U.S. can’t force it, being strictly limited to diplomacy, which has been hindered by Bukele’s resistance and the Trump administration’s focus on mass deportation. While due process demands action, El Salvador’s jurisdiction over its citizen, who lacks U.S. asylum, takes precedence, limiting U.S. justice’s reach. I agree he shouldn't have been deported, but practical and sovereign constraints suggest justice here is El Salvador’s to define, not the U.S.’s to impose.
Though the U.S. initiated the error, natural law prioritizes the common good; in this case, El Salvador’s right to manage its citizen’s threat outweighs the U.S.’s procedural lapse, a balance justice must accept in this case.
Just my two cents.

Many Brave Americans Still Languish in Prison
But let’s not forget the others who served and suffered, as many still do. Thousands of brave Americans courageously called out election fraud, fought to stop the steal last time, and paid enormous prices. Prisoners still languish in the J6 gulag.
Whether it is the mobs that looted and vandalized during the summer of 2020, or the mob that stormed the Capitol on January 6, 2021, or the mobs occupying campus buildings now, they are, qua mobs, all worthy only of contempt and it makes no difference what the cause is
America now has a two-tiered justice system: Antifa & BLM rioters roam free while peaceful January 6 protesters are imprisoned without bail. Biden’s “Department of Injustice” has executed over 1,000 arrests for nonviolent offenses related to January 6, casting a dark shadow over Lady Justice & the foundational principles of our legal system.
To unify this country, I commit as president to pardon all Americans who were targets of politicized federal prosecutions & those denied due process. This includes all peaceful, nonviolent January 6 protesters who were denied their constitutional due process rights. I will end the weaponization of police power in America. Every Republican candidate must be clear about where we stand on the hard issues.
