Did Cardinal Joseph Ratzinger (the  future Pope Benedict XVI) say that Francis is a heretic ?    On June 3, 2003 the then Cardinal Ratzinge r  (and future Pope Benedict) , head of the  Congregation for the Faith, said that the endorsement of  " homosex civil unions" was against  Catholic teaching, that is  heterodoxy :   "Those who would move from tolerance to the legitimatization of specific  rights for cohabiting homosexual persons need to be reminded that the  approval or legalization of evil is something far different from the  toleration of evil... The Church teaches that respect for homosexual  persons cannot lead in any way to approval of homosexual behavior or to  legal recognition of homosexual unions ." The college of cardinals with the status validated by the last validly elected pontiffs must note whether Benedict XVI has indeed abdicated, according to the norms of the Church at Pope John Paul II's Universi Dominici Gregis:
“1. During the vacancy of the Apostolic See, the College of Cardinals has no power or jurisdiction in matters which pertain to the Supreme Pontiff during his lifetime or in the exercise of his office; such matters are to be reserved completely and exclusively to the future Pope. I therefore declare null and void any act of power or jurisdiction pertaining to the Roman Pontiff during his lifetime or in the exercise of his office which the College of Cardinals might see fit to exercise, beyond the limits expressly permitted in this Constitution”.
In this way, they are obliged to observe Articles 76 and 77 of the same apostolic constitution.
