Is the Pope Above Canon Law?

On January 13, 2013, the Canon Law Made Easy website in a article titled "Can a Pope Ever Resign?" said in speaking of a canon 332.2 phrase on a pope's resignation having to be "properly manifested" said:

"[T]he Pope is the Church's Supreme Legislator, he can interpret this law however he wishes." [https://canonlawmadeeasy.com/2013/01/03/can-a-pope-everresign/]

On the other hand, the respected Fr. Brian Harrison in speaking on is the pope above canon law thought the statement "the pope is “above canon law” is a half-truth" according to a post on the Catholic Answers website:

The article “White Smoke, Valid Pope” by Fr. Brian Harrison (March 2001) makes an interesting but flawed argument against the sedevacantists’ claims about Rome. Fr. Harrison argues from canon law regulations on heresy and excommunication in order to show that a pope who incurs latae sententiae excommunication would be a valid but illicit pope. He writes, “While this [heretical] pope would offend God gravely by exercising his office while under an (undeclared) excommunication, all his official acts still would be juridicially valid.”

These arguments that place the pope under the rule of canon law are futile. A closer scrutiny of the situation would reveal that the pope answers only to God: The pope is the author of canon law, which depends solely on his will. Excommunication is a disciplinary decision of the Church, and thus the qualifications that automatically incur excommunication-such as advising someone to have an abortion-are subject to change.

Fr. Harrison writes, “A pope who began his pontificate as an orthodox Catholic but became a formal heretic or apostate during his pontificate would thereby legally incur excommunication.” That statement is an impossibility. The pope is above canon law and is not subject to excommunication.

Fr. Harrison replies: To say that the pope is “above canon law” is a half-truth. It is true in the sense that the pope has no superior on earth who could declare, enforce, or remove any penalty against him for breaches of the law. But it is false insofar as it means that he could never incur, in God’s sight, any such penalty or that he has no moral duty to act and govern the Church according to the law that he himself officially recognizes as valid at any given moment in his pontificate.

Canon law includes numerous prescriptions of divine law that no pope can ever overturn (see for example cc. 330, 925, 849, 864, and 1024 in the 1983 Code). Even the “merely” ecclesiastical law contained in the Code is for the universal Church, and the pope is morally obliged to be the first in giving a good example by living and acting as a law-abiding Christian. Of course, as supreme legislator, the pope may change any ecclesiastical law by officially and expressly abrogating it or derogating from it. But if he were to decree something which broke the law-that is, which acted against an existing ecclesiastical law without expressly adding a clause derogating from that law-then canon law itself (c. 38, 1983 Code; c. 46, 1917 Code) states that such a lawless action, even on the part of a “competent authority” (and that, of course, includes the pope) would have “no effect.” [https://www.catholic.com/magazine/print-edition/is-the-pope-above-canon-law]

The Pope is bound to Christ along with every other Catholic who ever lived. The Pope is bound to Doctrine, Scripture, Dogma and all Canon Laws that arise from it.

The Pope is not above Jesus Christ. Jesus Christ does not serve the Pope. Holy Mother Church does not serve the Pope. The Pope is the Servant of the Servants of God. He is bound no less than me or any other Catholic who ever lived to Jesus Christ.

*If the Pope is a heretic or apostate, he is excommunicate*. If that is not true, then the Catholic Faith is idolatrous, just as they used to say when I was a Protestant.

I reject Pope as supreme over Doctrine and Dogma and Scripture and Our Lord.

In reference to Fr. Brian Harrison (O.S.) professor emeritus of theology's assertion that the Pope can say and do anything and he will never be a heretic or apostate. I contend this is tantamount to idolatry, because he is saying by this that the Divine Law is subject to the will of a man. One Pope can assert that God is Three In One, Holy Trinity, one God. Another Pope can say that Allah is God and the Blessed Mother is now concubine of Allah in a Paradise of willing virgins. "And that's ok", (if a Pope can never be a heretic or apostate, that is). That explains his article on SSPX - Dissident Traditionalism - that similarly asserts the necessity to accept every Concilliar document that was produced by the II Vatican Council, such as, hmmm, Dignitatis Humanae. And now, it's fruit also, Pachamama and it's idolatrous witchcraft ceremony in the Vatican Gardens, attended by the "Pope". We are all Pachamama idolaters now. The Pope has spoken. Right, Fr. Harrison?

Wrong. Rejected.

"Idolatry etymologically denotes Divine worship given to an image, but its signification has been extended to all Divine worship given to anyone or anything but the true God. St. Thomas (Summa Theol., II-II, q. xciv) treats of it as a species of the genus superstition, which is a vice opposed to the virtue of religion and consists in giving Divine honour (cultus) to things that are not God, or to God Himself in a wrong way. The specific note of idolatry is its direct opposition to the primary object of Divine worship; it bestows on a creature the reverence due to God alone."

"Considered in itself, idolatry is the greatest of mortal sins. For it is, by definition, an inroad on God's sovereignty over the world, an attempt on His Divine majesty, a rebellious setting up of a creature on the throne that belongs to Him alone."

"The consummative cause of idolatry was the influence of the demons who offered themselves to the worship of erring men, giving answers from idols or doing things which to men seemed marvelous."

"But why did God permit such deviations from the truth? ... no satisfactory answer can be given to this question, it is the eternal problem of sin and evil. I do not worship the Pope. Never have. Never will. I worship Jesus Christ and submit to Holy Mother Church which is eternal, spotless, holy, unchanging forever.

Fr. Harrison would never admit that he does worship the Pope, but he does. If he maintains the Pope rules Doctrine and Dogma and is not it's servant, then he worships the Pope. And that is why we are in this idolatrous present moment of mortal crisis.

And that is exactly what our co-religionists in the new Abrahamic Faiths ®️profess, and our apostate Pope promotes, in the sacred fruit of Dignitatis Humanae's Religious Freedom. And we are supposed to accept this, because the Pope can make any Dogma he pleases.
